Tenants must have written conditions of a new contract before the lease day expires (or no later than 28 days after the conclusion of an existing tenancy agreement). On December 1, 2017, a new type of rental – private residential rent – came into effect, replacing secure and short-term leases for all new leases. Any new lease agreement beginning on December 1 or after December 1 must be made on a TRP if it is leased to an individual (or co-owner) who is his only house or main house, and this is not one of the excluded properties (listed in Schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016). Excluded properties include stores, licensed premises, farms, vacation homeowners or resident owners.
